Forest & Bird has filed a judicial review against the Minister for the Environment. The judicial review is about the amendments made to the NPSFM and NES-F in December 2022 and February 2023 in respect of natural inland wetlands, and in particular the new consent pathways provided for in the amendments. Forest & Bird says these amendments were unlawful because, amongst other things, they did not implement the objectives and policies of the NPSFM, and because they are not in accordance with Part 2 of the Resource Management Act 1991. Forest and Bird also say that the coal mining consent pathway is not consistent with statements made in the decision-making documents about climate change matters.
